1. Who you are contracting with

The AcquireVibe service (the "Service") is provided by Acquire Vibe ("we", "us"). By accessing or using the Service, you agree to these Terms & Conditions.

2. Acceptance

By creating an account, accessing, or continuing to use the Service, you accept these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age and have authority to bind any organization on whose behalf you use the Service.

3. The Service

AcquireVibe is a marketplace and toolset for buying, selling, and analyzing online businesses (SaaS, newsletters, AI tools, creator businesses). Specific features depend on your plan.

4. Account and accuracy

You must provide accurate information, keep it up to date, and maintain the confidentiality of your credentials. You are responsible for activity under your account.

5. Acceptable use

You must not misuse the Service. Without limitation, you must not:

• use the Service unlawfully or for fraud or spam;
• infringe intellectual property or other rights;
• interfere with security, probe, scan, scrape, or introduce malware;
• misrepresent listings, financials, or your identity.

6. Intellectual property

We retain all rights, title, and interest in the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan. You must not reverse engineer, resell, or circumvent technical limits.

7. User content

You retain ownership of content you submit. You grant us a limited license to host and process your content solely to provide the Service.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds are governed by the Paddle Buyer Terms. See our Refund Policy for refund details.

9. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we will provide a reasonable window to export your data where feasible.

10. Service level and warranties

The Service is provided "as is". We do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing limits liability for fraud, death, or personal injury where it cannot be limited by law.

12. No financial advice

Information on the Service (including valuations, multiples, and reports) is for general and educational purposes only and is not financial, investment, legal, or tax advice. Your decisions are your own responsibility.

13. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Acquire Vibe resides, and disputes will be resolved in the competent courts of that jurisdiction, unless mandatory local law provides otherwise.

15. Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.
